72-year-old accused of battering 69-year-old

April 30, 2014

A 72-year-old Marathon man was arrested Monday for ripping down an entrance gate to a trailer park reserved for those age 55 and older, and then attacking the park's owner.

According to the Monroe County Sheriff's Office, Ralph Mutchnik, owner of the Galway Bay park at mile marker 47.5, called the agency around 11:30 a.m. Monday to report that security cameras had captured resident Jerome Kaczmarek damaging the gate and then running over it in his black Ford Excursion at 9:30 p.m. the night before.

A deputy met with the park's IT consultant to review video and found that Kaczmarek was "seen exiting his vehicle and forcefully pulling the gate down before he gets in his truck and drives over the gate."

While meeting with the IT consultant, the deputy received a call that "Mutchnik was calling in saying that Kaczmarek just came to the office and the trailer park and battered him."

Mutchnik, 69, and another witness, Luis Molina, told deputies Kaczmarek kicked Mutchnik twice and punched him in the left eye.

Kaczmarek told police "he bumped into the gate and it bent" and denied the battery claim. He was charged with third-degree felony battery on a person 65 or older and misdemeanor criminal mischief.

Galway Bay staff estimated damage to the gate is worth $600.
